Meanwhile, legislators plan to introduce fines for storage, production, distribution and transportation of extremist materials.
On March 16, the state-run newspaper Zvyazda published the republican list of extremist materials. The list is compiled following court decisions to recognize this or that print material an extremist product. The list includes books, newspapers, websites, CD discs, pages from social nets and YouTube channels, and also stamps, coins, brooches, and even a pottery set of 21 pieces.
Mostly, the list includes books on religious topics, written by or about Hitler, dealing with conspiracy theories, some of the titles refer to Holocaust, Jewish revolution, and the like. It also includes strongly disputable materials, like the Press Photo Album 2011: the album represents winning photos of the national contest of press photography published in 2010 in Belarusian mass media. Nothing but truth, but in 2013 the Ashmiany district court ruled that the album showed distorted facts denigrating the Belarusian state. Forty copies of the album were confiscated from its owners; the court ruled to detroy them.
Besides, there are CDs “Lesson of the Belarusian Language”, a concert Solidarity with Belarus held in Warsaw on March 12, 2006. It enumerates some pages of social nets: three communities from Vkontakte represent an underground youth community covering political, ecological and artistic protests; the pages are available through Belarusian providers. The websites misanthropic.info and misanthropic.in are blocked by providers according to legislation.
Meanwhile, the legislators draft amendments to the Code of Administrative Violations: now article 17.11 sounds like “production and storage of extremist materials”; the changes envisage the violation as “distribution, production, storage and transportation of informational materials containing calls for extremist activities or propagating such activities”. The violation will be punishable by fines: from 4.2 million rubles for physical persons, ranging from 4.2 to 10.5 million rubles for self-employed entrepreneurs, and ranging from 10.5 to 42 million rubles for legal entities. However, fines for the products mentioned in the republican list of extremist materials are even higher: from 2.1 to 10.5 million rubles for physical persons, from 10.5 to 21 million rubles for self-employed entrepreneurs, and from 21 to 105 million rubles for legal entities. Two million rubles is something like 100USD, 100 million rubles is something like 5000USD.
Закон РБ «Аб супрацьдзеянні экстрэмізму» дзейнічае з пачатку 2007 года. Паводле арт. 1 закона, пад паняцце экстрэмізму падпадае не толькі дзейнасць, накіраваная на гвалтоўнае змяненне канстытуцыйнага ладу альбо захоп улады неканстытуцыйным шляхам, але і распальванне расавай, нацыянальнай, рэлігійнай, сацыяльнай варожасці, прыніжэнне нацыянальнага гонару і годнасці, арганізацыя і ажыццяўленне масавых беспарадкаў і г.д. Экстрэмісцкія матэрыялы — гэта інфармацыйная прадукцыя, якая ўтрымлівае заклікі да экстрэмісцкай дзейнасці, прапагандуе яе, прызначаная для распаўсюду і прызнаная экстрэмісцкімі матэрыяламі па рашэнні суда.
Паводле арт. 14 Закона «Аб супрацьдзеянні экстрэмізму», копія судовага рашэння аб прызнанні інфармацыйнай прадукцыі экстрэмісцкай накіроўваецца ў Міністэрства інфармацыі для «ўключэння такой інфармацыйнай прадукцыі ў рэспубліканскі спіс экстрэмісцкіх матэрыялаў, які падлягае апублікаванню ў СМІ». Паводле гэтага ж артыкулу, змест інфармацыйнай прадукцыі, уключанай у такі спіс, не разгалошваецца.
